3. Aquifer Test Procedures:

   • If deemed necessary, the commissioner will require a new aquifer test within 30 days of receiving a complete application, with specified guidelines that the applicant must follow. Applicants bear the cost of these tests.

4. Decision Timeline: The commissioner must either approve or deny a water use permit within 150 days of receiving a completed application. If a new aquifer test is needed, the decision must be made within 120 days after test results are submitted.

5. Extensions:

   • The decision timeline can be extended if required by state or federal law or court order.
   • The extension is allowed for up to 60 days beyond the initial process completion deadline.
   • The commissioner can extend the timeline before it ends by notifying the applicant, with a maximum additional extension of 60 days, unless further approved by the applicant.
   • Applicants can request extensions in writing.
