Main Provisions

• Advertising Regulation: Clarifies what constitutes advertising for veterans benefits appeal services. This includes brochures, letters, television, and more, but excludes identification writing on buildings and normal business communications.

• Compensation Limitations:

  • It prohibits charging veterans for referrals to other veterans benefit services providers.
  • It restricts compensation for services related to claims filed within one year of a veteran’s release from active duty unless the veteran explicitly waives this provision.
  • The bill insists that any compensation must be tied to the successful increase in benefits awarded and caps the total compensation to a maximum of five times the monthly benefit increase.
  • It forbids initial or nonrefundable fees and any guarantees of successful claims or specific benefits.

• Data Protection and Integrity Requirements:

  • Prohibits the use of international call centers or data centers for processing veterans’ personal information.
  • Forbids using a veteran’s personal login information to access their accounts.
  • Mandates background checks for anyone accessing a veteran's personal information, including verifying identity and checking criminal records.
