Purpose

Clarify how money provided to the Minnesota Climate Innovation Finance Authority (MCIFA) can be used and codify the authority’s general powers. The bill updates Minnesota Statutes to ensure the MCIFA has explicit authority to finance climate-related projects, contract with a wide range of partners, manage property and funds, and support activities related to reducing greenhouse gas emissions in the state.

Main Provisions

• General powers for the MCIFA (Section 216C.441 subdivision 3, as amended):
  • Hire an executive director and staff; sue and be sued; have a seal and alter the seal.
  • Acquire, hold, lease, manage, and dispose of real or personal property for the authority’s purposes.
  • Enter into agreements and other transactions with a broad set of partners, including:
  • Tribal governments, any federal or state agency, counties, local units of government, regional development commissions, and various private or public entities (partnerships, corporations, associations, or organizations).
  • Acquire real property or interests in real property in the authority’s name when necessary or appropriate.
  • Provide general technical and consultative services related to the authority’s purpose.
  • Promote research and development related to the authority’s mission.
  • Conduct market analyses to identify underserved markets.
  • Analyze greenhouse gas emissions reduction project financing needs in Minnesota and recommend measures to address any financing capacity shortages.
  • Contract with governmental or private entities for services such as legal counsel, financial advisory, investment banking, or other help.
  • Enter into agreements with qualified lenders or others to insure or guarantee to the state the payment of qualified loans or other financing instruments.
  • Accept gifts, grants, or an interest in money or personal property on behalf of the state; funds received under this authority must be deposited into the account described in subdivision 11.
