Main Provisions

• Remote Reassessments: The bill authorizes the use of remote technologies, such as interactive video or telephone, to conduct reassessments for individuals receiving certain disability waiver services. These can substitute in-person reassessments under specified conditions.

• Sequential Remote Assessments:

  • For services under the developmental disabilities waiver, community access, community alternative care, and brain injury waiver programs, two consecutive remote reassessments may be conducted if followed by an in-person reassessment.
  • For alternative care, essential community supports, and services under the elderly waiver, one remote reassessment may be conducted if followed by an in-person reassessment.
  • For personal care assistance and community first services and supports, two remote reassessments may be used if followed by an in-person reassessment.

• Informed Consent Requirement: The use of remote reassessments requires the informed consent of the individual receiving the services or their legal representative. They must be offered the choice and may refuse a remote reassessment.

• Assessor's Discretion: If during a remote reassessment the certified assessor thinks an in-person assessment is necessary to complete the reassessment process, they must arrange for it to occur.

• Compliance with Existing Standards: Remote reassessments must comply with the same standards and requirements as in-person reassessments, including updating the individual's support plan.
